Hirschler healthcare partner John Ivins co-authored an article with Kathleen Pankau, Senior Assistant General Counsel at The Joint Commission, and Emma Pelkey, an attorney in the Portland office of Lewis Brisbois, for the July issue of Health Law Connections, the official magazine of the American Health Law Association (AHLA).
The article, entitled, “Unique Challenges for Behavioral Health Providers in Protecting Health Care Workers While Balancing the Needs of Patients,” discusses the challenges faced by behavioral health providers and their employees who frequently experience injury while providing needed patient care. The article reflects on existing regulation – particularly how OSHA and The Joint Commission address these concerns – and as well as recent cases which illustrate the challenges.
